A new bill filed by State Rep. Tim Longest in the North Carolina House seeks to ensure tenants receive written notice before landlords impose late fees on overdue rent, according to the North Carolina State House.
The bill, filed as HB 990 on April 10 during the 2025 regular session, was formally listed with the short title: ‘Notice Requirements for Landlord Fees.’
The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.
In essence, this bill mandates that landlords provide tenants with written notice before assessing a late fee for overdue rent payments. The notice must be delivered by hand, mail, or electronically as agreed in the rental agreement, and it must state that a late fee will be or has been applied if the rent is not received by the later of five days after the due date or the number specified in the lease, which must be at least five days. The notice must also include the fee amount and the date it was imposed, if applicable. This act will be effective Oct. 1, 2025, and is applicable to late fees imposed on or after that date.
Of the three sponsors of this bill, Tracy Clark proposed the most bills (27) during the 2025 regular session.
Bills in North Carolina follow a multi-step process before becoming law. A lawmaker starts by filing a bill, which is assigned to a committee for review. The bill must be read three times in each chamber. If one chamber changes the bill after the other passes it, both must agree on the final version. Once both chambers approve the same bill, it goes to the governor, who has 10 days (or 30 if the legislature is not in session) to sign, veto, or let it become law without a signature.
